This action settled for $1.26 Million Dollars during jury selection. Plaintiff a 30 year-old teacher’s aide, was heading towards Queens on the Throgs Neck bridge when their vehicle became disabled. She moved to the right lane and got out of her vehicle in an attempt to flag down a motorist to help. Defendants van, which was traveling in the same direction in that lane, struck the stalled vehicle at approximately 40 mph. Defendants contention was that he was attempting to change lanes when he was forced over into the right lane by a passing truck.

Injuries: fractures of both legs requiring open reductions and internal fixations with a nonunion requiring a bone graft. Plaintiff also suffered a left foot tibial nerve injury causing a drop foot. She was left with disfiguring scars on her lower extremities. Plaintiff has not returned to work as of the date of settlement. Carrier: Royal-Sun alliance with Zurich Insurance on the excess over $1 million.
